DAR ES SALAAM, Tanzania (AFP)–President George W. Bush said Sunday that he supports a U.N. envoy’s plan for the independence of Kosovo, poised to become the world’s newest state.
“On Kosovo, our position is that its status must be resolved in order for the Balkans to be stable. Secondly, we have strongly supported the Ahtisaari plan,” Bush said, referring to a so-called “supervised independence” plan put forward by the former Finnish president and U.N. special envoy Martti Ahtisaari.

They had waited so long but just couldn’t wait any longer to celebrate independence. The streets of Pristina have been filled with people cheering and shouting, with cars honking their horns in a continuous cacophony.
They drive round and round draped in flags, young men perched precariously on the roofs jiggling up and down with joy. In the midst of mayhem, an old man closes his eyes and reverentially kisses a scarf emblazoned with the word “Kosovo.” And you can see my TV report here.
Two young women drive, clapping their hands in time with the Turkish-style pop blaring out of the speakers.
A man in full, white Albanian national costume stands stock-still on the top of a car driving along. Cynics might see the gingerly-driven car, an Albanian flag on its bonnet, the stars and stripes totally and utterly obscuring the windscreen, as a metaphor for an uncertain future.
“The message is clear,” says one man wearing a T-shirt bearing a single upright finger and the words “Bye bye Serbia “.
Another young man is even more succinct. When I ask him what he thinks he replies with three words, one Anglo-Saxon. Only “off” and “Serbia” are printable.
When I say that I can’t broadcast that, and can he put it another way, he thinks and puts the word “Serbia” first, followed by the rest.
The authorities desperately hope there is no in-your-face provocation towards the Serb minority here.
Awash with flags
Kosovo is awash with flags, determined to party.
This place is never short of flags, but now the Albanian black eagle on a red field is ubiquitous. In the capital, Pristina, some cars have twin miniature flags discreetly flying from their bonnets, others go the whole hog and have a huge flag draped across the boot.
I’m told that an incredible 80 tonnes of fireworks have been brought in and distributed all over the country. I watch as a team of women spread cream and chocolate on sections of a giant cake that is intended to feed 30,000 people. It took 11,800 eggs. You can’t make a nation without breaking more than a few eggs, apparently.
About 40 miles from the capital, I come across a group of men determined to put up a banner reading “Celebrate independence!” across the road, hanging it from a half constructed building, flags flying predictably from every corner.
Even the cement mixer by its side has a large flag attached, and the men argue amiably about the best way to get the banner up as lorries and coaches get entangled in it as they pass.
What does independence mean to them? One man tells me: “This day is for all citizens who want to be free. So many people gave their lives and sacrificed so much for this country.”
Four flags
Although the black eagle is everywhere, this Independence Day is a tale of four flags. Cars and buildings also fly the Union Jack and Stars and Stripes. Kosovo is one of the few places in the world that people will shake you firmly by the hand and thank you for Britain’s support.
This day may have been along time coming, but the majority Albanian population know that it was the Nato bombing campaign against Serbia that insured that they would and could one day split from that country.
As I get ready to do a piece to camera in the middle of Mitrovica, one man comes up to thank my country, and give me a firm handshake.
“It’s the most momentous moment for the Albanians here, because we had 500 years of occupation from a really terrible, horrendous occupier,” he says. “There’s been so much bloodshed that now we’re really happy.”
Formally what happens today is that the Prime Minister calls MPs together and parliament approves a bunch of laws described in the Ahtisaari plan. And then he will declare independence and the party will begin with classical music and later those fireworks.
There are government notices everywhere, including on the back of free T-shirts, asking people to “celebrate with dignity”. And I’ve heard they are also asking everyone to go home shortly after midnight. Informally it might be rather more raucous than that, as joy is unbound.
Day of tragedy
Of course not every one who lives here feels that way. For many Serbs this is a day of tragedy.
In Mitrovica it is just a short walk across a bridge to the Serbian side of town, over-looked by French snipers and Nigerian UN soldiers. Here, of course, there is no bunting, nothing hanging from cars.
Under a rather tattered Serbian flag there is some building work going on. I ask a man shovelling bricks into a wheelbarrow what independence will mean for him. He frantically shovels more bricks and says that he will stay and work, work hard. As for independence, he says, it’s like him coming to my house and saying that it is his. A teenaged boy interjects: “We may celebrate: with guns”.
I ask him what he means. He says that if the Albanians try to bring their celebration across the bridge, to taunt them, they will be ready to defend themselves. But I think the Serbian mood is as much sorrow as anger.
Today is a big day, an emotional day. But how much difference will independence make? Kosovo will declare independence today, but in a sense that is independence from the United Nations, because in reality it has not been ruled from Belgrade for nine years.
While Serbs may regard it as legally part of their country, for nine years there have been borders, and checks on documents between Serbia and Kosovo.
Equally in the north of Mitrovica, and other parts of Kosovo where Serbs live, they use their own currency and under the plan they will have a great deal of autonomy. Of course this does beg the question why they can’t choose to be part of Serbia if ethnic Albanians have the right to live in a new country.
EU flag
I wrote that this was a tale of four flags. The fourth flag is the European Union flag, which again you see hanging from every third building. Indeed I’m told Kosovo’s official flag will probably be pretty much like the EU flag with a map of the country inside the golden stars.
Some might think that rather justly symbolic: Kosovo will have a sort of independence but within parameters set down by the European Union.
Diplomats are very keen to stress that today does not see the United Nations hand over to the European Union. Whereas the UN really was running the show, the EU will just be there to keep an eye on things. But the EU can, in the end, tell the government what to do and what not to do in certain areas.
One senior EU source puts it like this: “We have a big stick. But that big stick is locked in a safe in the cellar. And it would take a lot to make us get the keys out and go downstairs. But we can do it.”
One of the most important people around here is Roy Reeve, a former British diplomat with an easy manner who is at the moment in charge of planning the EU police mission, the biggest task the European Union has ever undertaken.
EU protectorate
I ask him if the arrangement doesn’t make Kosovo an EU protectorate, or even colony.
“It’s been a protectorate up until now but the responsibility is theirs now,” he says. “They are the new government, it’s for them to deliver results. Whatever we’re here to do, it’s not to leap in and take decisions on their behalf, but to work with them to make it clear that they are the ones in charge.”
It is more than simply ironic that, with the EU taking on such a big burden, it cannot get its act together. At tomorrow’s foreign ministers meeting there will be a smooth papering over the cracks, and then about 20 countries will recognise Kosovo.
That would leave seven not really on board for what some might see as the EU’s biggest project to date. But for the time being, that is not what is most important.
The next 24 hours will bring reaction from all around the world. But what happens here, on the ground, is what is vital. Let’s hope the only fireworks are part of the celebratory display.

The recognition of independence for Kosovo raises serious questions of international law as well as sensitive diplomatic difficulties.
The United States and many European Union countries accept that Kosovo should no longer be formally part of Serbia.
They will recognise a limited form of independence for Kosovo, as recommended in a report drawn up for the UN by the former Finnish president Martti Ahtisaari.
The EU is sending a major law and order mission to Kosovo, made up of 1,800 police and justice officials, including judges, in effect taking over from the current UN presence.
Serbia itself, supported strongly by Russia, rejects independence for Kosovo. Serbia and Russia argue that there is no UN Security Council approval for the move and that the parties should continue negotiating until an agreement is reached.
Serbia offered Kosovo autonomy but not independence.
So what are the legal arguments for and against recognition?
The arguments for
After the war over Kosovo in 1999, the UN Security Council took control. In resolution 1244 of 10 June 1999, it ordered the Federal Republic of Yugoslavia (as it then was) to withdraw all its forces from Kosovo and hand Kosovo over to the UN.
The problem is that although the resolution called for a “political solution to the Kosovo crisis”, it did not specify what that solution should be.

EU document
And there has not been any further Security Council resolution mandating independence for Kosovo.
Many Western governments argue that because 1244 does refer to general principles that G8 foreign ministers had agreed in advance of the resolution, these should be used as the basis for the acceptance of independence now.
These principles include the deployment in Kosovo of “international civil and security presences” and “facilitating a political process designed to determine Kosovo’s future status”.
EU legal opinion
The European Union has drawn up, as it is required to do by EU procedures, a document to justify its own mission to Kosovo and the arguments deployed are the same as the ones used to justify recognition.
The document basically argues that independence for Kosovo is within the spirit of 1244, if not strictly within the letter.
The 1244 resolution also envisaged a final status process and did not constrain or pre-determine its outcome.
“Acting to implement the final status outcome in such a situation is more compatible with the intentions of 1244 than continuing to work to block any outcome in a situation where everyone agrees that the status quo is unsustainable,” it says.
The document adds that this approach “will enable, rather than frustrate, the conclusion of the final status process envisaged in resolution 1244″.
And it gives approval to international recognition: “Generally, once a entity has emerged as a state in the sense of international law, a political decision can be taken to recognise it.”

UN plans to tackle limbo
Nato troops under the Kosovo Force (K-For) continue to be mandated by 1244, the opinion holds.
As for the legality of the EU mission, the argument is that there is nothing to stop the EU from taking over from the UN, as 1244 simply refers to “international civil and security presences”. In addition, it suggests that Kosovo could invite the EU to undertake this role.
The document interprets references in the 1244 preamble to Kosovo being part of the Federal Republic of Yugoslavia and to the “territorial integrity” of Yugoslavia as being non-binding.
The arguments against
The counter-argument by Serbia and Russia is simpler. It is that Serbia, the sovereign state, has not agreed to independence for Kosovo, that there is no Security Council resolution authorising the detachment of Kosovo from Serbia and that therefore its independence is illegal.
Some European Union members - Greece, Spain, Cyprus, Slovakia, Bulgaria and Romania - agree, though they have not blocked the EU mission.
Serbia remains strongly opposed to independence
Serbia and Russia also say that 1244 itself gives no authority for independence. They point to article 10 of 1244 which authorises “substantial autonomy with the Federal Republic of Yugoslavia” for Kosovo, meaning, in their view, that 1244 blocks independence.
And they argue that 1244 talks about international organisations being deployed in Kosovo “under United Nations auspices”, which an EU mission would lack.
Russian Foreign Minister Sergei Lavrov had this to say on 12 February: “We are speaking here about the subversion of all the foundations of international law, about the subversion of those principles which, at huge effort, and at the cost of Europe’s pain, sacrifice and bloodletting have been earned and laid down as a basis of its existence.
“We are speaking about a subversion of those principles on which the Organisation for Security and Co-operation in Europe rests, those [principles] laid down in the fundamental documents of the UN.”
The main principle he refers to is that borders should be changed only by agreement.
In Russia and Serbia’s view, since there is no agreement, there should be no recognition.
KOSOVO PREPARES FOR FIRST INDIPENDENCE DAY
PRISTINA, Kosovo (CNN) — Kosovo’s parliament meets Sunday afternoon to officially declare the province’s independence from Serbia, a move opposed by Serbia and Russia but supported by many western governments.
CNN’s Alessio Vinci, reporting from the Kosovar capital Pristina, said that the plan is for Kosovo Prime Minister Hashim Thaci to read out the independence declaration, which is written in Albanian, Serbian and English, to parliament before lawmakers pass it unanimously.
Vinci added that Kosovo’s Albanian population were already singing and dancing in the streets as well as lighting firecrackers ahead of the much anticipated vote. “It’s been like this for several hours now,” he said.
President George Bush said Sunday that Kosovo’s status must be resolved before the Balkans can become stable and that the United States supports the Ahtisaari plan which calls for a form of supervised independence.
The European Union decided Saturday to launch a mission of about 2,000 police and judicial officers to replace the United Nations mission that has been controlling the province since the end of the war with Serbia in 1999.
Kosovo has been under U.N. supervision and patrolled by a NATO-led peacekeeping force since the end of the three-month war, in which NATO warplanes pounded Serbia to roll back a campaign of “ethnic cleansing” of the province’s Albanian population under former then-President Slobodan Milosevic.
The disputed province is dear to the Serbs, Orthodox Christians who regard it as Serbian territory. But it is equally coveted by Kosovo’s ethnic Albanians, Muslims who have a 90 percent majority, and two years of talks on its final status ended in failure last December.
“Its status must be resolved in order for the Balkans to be stable,” President Bush told reporters during a news conference in Tanzania Sunday.
Bush said the Ahtisaari plan — named after former Finnish President Marti Ahtisaari — is the best option. The proposal would give Kosovo limited statehood under international supervision.
President Bush added that “it’s in Serbia’s interest to be aligned with Europe and the Serbian people can know that they have a friend in America.” Watch the changing political climate in the Balkans »
“We are heartened by the fact that the Kosovo government has clearly proclaimed its willingness and its desire to support Serbian rights in Kosovo,” Bush said.
Thaci said Thursday he would establish a new government office for minorities and it would protect the rights of minorities after the province declares independence.
Serbian Foreign Minister Vuk Jeremic has promised his country will refrain from using force against Kosovo after independence, though he has warned that Serbia will take punitive diplomatic, political, and economic measures against the province.
Russia — Serbia’s historic ally — has remain opposed to Kosovo’s independence. Russia, which has fought two wars against separatist rebels in its southwestern republic of Chechnya, has Monday that U.S. and European support for Kosovo’s independence could lead to an “uncontrollable crisis” in the Balkans.
The EU said Saturday that “around 1,900 international police officers, judges, prosecutors and customs officials and approximately 1,100 local staff will be based in headquarters in Pristina or located throughout the judicial and police system in Kosovo.”
The EU mission’s objective is “to support the Kosovo authorities by monitoring, mentoring and advising on all areas related to the rule of law, in particular in the police, judiciary, customs and correctional services,” it said.
In 1999 the international, NATO-led Kosovo Force (KFOR) began providing security for the Serbian province.
“KFOR is fully determined to maintain a safe and secure environment for the times to come. KFOR is almost fully deployed and we will still increase our level of activities for the next couple of days,” said Lt. Gen. Xavier Bout de Marnhac, KFOR commander.
“I just want to state very strongly that KFOR will react and will oppose any kind of provocation that might happen during these days, wherever they come from — either from the Albanian or the Serbian side. Following are highlights of the declaration adopted by the Kosovo parliament, in the official English translation:

We also invite and welcome the North Atlantic Treaty Organisation to retain the leadership role of the international military presence in Kosovo and to implement responsibilities assigned to it under U.N. Security Council resolution 1244 (1999) and Ahtisaari Plan, until such time as Kosovo institutions are capable of assuming these responsibilities.
- Kosovo declares its commitment to peace and stability in our region of southeast Europe. Our independence brings to an end the process of Yugoslavia’s violent dissolution. While this process has been a painful one, we shall work tirelessly to contribute to a reconciliation that would allow southeast Europe to move beyond the conflicts of our past and forge new links of regional cooperation. We shall therefore work together with neighbours to advance a common European future.

Kandidatja demokrate Hillari Klinton ka pershendentur deklaraten “historike” te pavaresise se Kosoves, ndersa u ka bere thirrje vendeve mike dhe aleate “te bashkohen me SHBA dhe BE per njohjen e Kosoves se pavarur”. Sipas senatores se Nju Jorkut, deklarata e Prishtines do t’i lejoje Kosoves dhe Serbise “te hedhin pas kraheve nje kapitull te veshtire ye historise se tyre”. Hilari vuri theksin “qe zgjidhja e kesaj ceshtjeje ka marre shume kohe dhe i ka penguar te dy popujve te shohin perpara dhe te ndjekin nje te ardhme me te mire europiane dhe euroatlantike”.

La réaction de Moscou n’a pas tardé. Sitôt l’indépendance du Kosovo votée par le Parlement kosovar, dimanche 17 février dans l’après-midi, la Russie a immédiatement soutenu la Serbie en rejetant dimanche la proclamation d’indépendance du Kosovo. Elle a appelé les Nations unies à déclarer “nulle et non avenue” cette déclaration unilatérale d’indépendance.
Avant même cette déclaration d’indépendance, la Serbie avait prévenu qu’elle “ne reconnaîtrait jamais l’indépendance” de sa province sud. “Pour les citoyens de Serbie, pour la Serbie, il n’y a pas et il n’y aura jamais d’Etat fantoche du Kosovo sur son territoire”, a redit le premier ministre serbe, Vojislav Kostunica qui s’en est également pris au président américain George W. Bush pour son soutien à la proclamation de l’indépendance du Kosovo.
Les Etats-Unis, qui ont en effet “pris note” de la déclaration d’indépendance du Kosovo, ont appelé toutes les communautés au calme, selon un communiqué du porte-parole du département d’Etat, Sean McCormack. Le porte-parole a indiqué que les Etats-Unis et l’Union européenne se concertaient pour la suite à donner à cette déclaration d’indépendance, et qu’une reconnaissance, qui devrait être simultanée, interviendrait après un bref délai.
LA FRANCE SOUHAITE “BONNE CHANCE” AU KOSOVO
La Slovénie, qui assume la présidence semestrielle de l’Union européenne (UE), a appelé toutes les parties impliquées au Kosovo à se comporter “de manière responsable” et à “éviter toute forme de violence”. Le diplomate en chef de l’Union européene, Javier Solana, a appelé “tout le monde à agir calmement et de façon responsable”, et s’est dit “convaincu” que les dirigeants kosovars seraient “à la hauteur de leurs responsabilités”.
Plusieurs capitales européennes ont adopté une même attitude prudente. Rome a ainsi “pris acte” de la déclaration d’indépendance du Kosovo, mais “prendra le temps de l’évaluer” avec ses partenaires européens à Bruxelles lundi, selon des sources diplomatiques citées dimanche par l’agence Ansa, qui ont appelé Serbie et Kosovo à la “modération”. Même réaction du côté de l’Allemagne dont le ministre des affaires étrangères, Frank-Walter Steinmeier, a appelé toutes les parties” au “calme et à la modération”. En France, le ministre des affaires étrangères, ancien Haut représentant de l’ONU au Kosovo, Bernard Kouchner, a souhaité “bonne chance au Kosovo”, estimant qu’il s’agissait d’un “succès de la communauté internationale et de l’Europe” qui “mettra fin à une certaine souffrance”.
L’IRLANDE VA RECONNAÎTRE L’INDÉPENDANCE DU KOSOVO
La Suisse attend de son côté de la part des autorités du Kosovo qu’elles s’engagent à “protéger les droits de toutes les minorités”, a déclaré le ministère des affaires étrangères suisse. La reconnaissance du Kosovo par la Suisse ne se fera “qu’après consultations des commissions de politique étrangère”, a ajouté le ministère.
Dès dimanche, l’Irlande a annoncé son intention de reconnaître l’indépendance tandis que la Grande Bretagne a estimé qu’il s’agissait là d’un “important développement”. Lundi les ministres européens des affaires étrangères de l’Union européenne vont discuter du nouveau statut du Kosovo. Chaque Etat membre pourra effectuer une déclaration propre, les 27 pays membres étant divisés sur le sujet. Six pays européens, Chypre, Slovaquie, Espagne, Bulgarie, Grèce, la Roumanie ont déjà exprimé leur opposition à cette indépendance, la considérant comme un précédent pour les séparatismes à travers le monde.
La Slovaquie ne compte pas pour l’instant reconnaître l’indépendance du Kosovo, a annoncé à Bratislava le ministère slovaque des affaires étrangères. L’Albanie a enfin salué la proclamation de l’indépendance du Kosovo et a annoncé considérer le 17 février comme le jour de “sa rennaissance”, a déclaré le premier ministre albanais Sali Berisha.
L’Abkhazie et l’Ossétie du Sud demandent leur indépendace

Sikur te kishte ekzistuar interneti ne kohet e Ismailit e Ises, gje tjeter do t ekishte qene, por te shkretet moren rruget e Shqiperise me karroca dere me dere. Sot, gjithçka eshte falas, e shpejte dhe efikase.
Nga fotot e NYC vura re qe mungonte flamuri kosovar, ndoshta amerikanet kane menduar se eshte shpallur pavaresia e Shqiperise. Megjithate bravo per regullin, duket se ju andej nga USA jeni me patriote dhe keni me shume organizim sesa ne ne Evrope ku jemi pak te ndrojtur nga te tjeret.
Tani fillon puna, kush e njeh dhe kush nuk e njeh dhe se çfare do na rrefeje historia sepse serbomedhenjte nuk jane bere akoma pula e gomere per te leshuar armet, se ato aq dine, te djegin fshatra, te perdhunojne dhe te urrejne. Fatkqesite akoma nuk kane perfunduar per kombin shqiptar. Por, siç edhe peshkopi Artemije e tha, ata mendojne akoma tek armet, tek bajonetat, tek djegjet, vjedhjet dhe çudnimin e popullit kosovar.
Nga Brukseli duhet te vine lajme besoj, nese ndonjeri eshte ne lidhje, te mos pertoje te na informoje.

DAR ES SALAAM, Tanzania (AFP)–President George W. Bush said Sunday that he supports a U.N. envoy’s plan for the independence of Kosovo, poised to become the world’s newest state.
“On Kosovo, our position is that its status must be resolved in order for the Balkans to be stable. Secondly, we have strongly supported the Ahtisaari plan,” Bush said, referring to a so-called “supervised independence” plan put forward by the former Finnish president and U.N. special envoy Martti Ahtisaari.

They had waited so long but just couldn’t wait any longer to celebrate independence. The streets of Pristina have been filled with people cheering and shouting, with cars honking their horns in a continuous cacophony.
They drive round and round draped in flags, young men perched precariously on the roofs jiggling up and down with joy. In the midst of mayhem, an old man closes his eyes and reverentially kisses a scarf emblazoned with the word “Kosovo.” And you can see my TV report here.
Two young women drive, clapping their hands in time with the Turkish-style pop blaring out of the speakers.
A man in full, white Albanian national costume stands stock-still on the top of a car driving along. Cynics might see the gingerly-driven car, an Albanian flag on its bonnet, the stars and stripes totally and utterly obscuring the windscreen, as a metaphor for an uncertain future.
“The message is clear,” says one man wearing a T-shirt bearing a single upright finger and the words “Bye bye Serbia “.
Another young man is even more succinct. When I ask him what he thinks he replies with three words, one Anglo-Saxon. Only “off” and “Serbia” are printable.
When I say that I can’t broadcast that, and can he put it another way, he thinks and puts the word “Serbia” first, followed by the rest.
The authorities desperately hope there is no in-your-face provocation towards the Serb minority here.

This place is never short of flags, but now the Albanian black eagle on a red field is ubiquitous. In the capital, Pristina, some cars have twin miniature flags discreetly flying from their bonnets, others go the whole hog and have a huge flag draped across the boot.
I’m told that an incredible 80 tonnes of fireworks have been brought in and distributed all over the country. I watch as a team of women spread cream and chocolate on sections of a giant cake that is intended to feed 30,000 people. It took 11,800 eggs. You can’t make a nation without breaking more than a few eggs, apparently.
About 40 miles from the capital, I come across a group of men determined to put up a banner reading “Celebrate independence!” across the road, hanging it from a half constructed building, flags flying predictably from every corner.
Even the cement mixer by its side has a large flag attached, and the men argue amiably about the best way to get the banner up as lorries and coaches get entangled in it as they pass.
What does independence mean to them? One man tells me: “This day is for all citizens who want to be free. So many people gave their lives and sacrificed so much for this country.”
Four flags
Although the black eagle is everywhere, this Independence Day is a tale of four flags. Cars and buildings also fly the Union Jack and Stars and Stripes. Kosovo is one of the few places in the world that people will shake you firmly by the hand and thank you for Britain’s support.
This day may have been along time coming, but the majority Albanian population know that it was the Nato bombing campaign against Serbia that insured that they would and could one day split from that country.
As I get ready to do a piece to camera in the middle of Mitrovica, one man comes up to thank my country, and give me a firm handshake.
“It’s the most momentous moment for the Albanians here, because we had 500 years of occupation from a really terrible, horrendous occupier,” he says. “There’s been so much bloodshed that now we’re really happy.”
Formally what happens today is that the Prime Minister calls MPs together and parliament approves a bunch of laws described in the Ahtisaari plan. And then he will declare independence and the party will begin with classical music and later those fireworks.
There are government notices everywhere, including on the back of free T-shirts, asking people to “celebrate with dignity”. And I’ve heard they are also asking everyone to go home shortly after midnight. Informally it might be rather more raucous than that, as joy is unbound.
Day of tragedy
Of course not every one who lives here feels that way. For many Serbs this is a day of tragedy.
In Mitrovica it is just a short walk across a bridge to the Serbian side of town, over-looked by French snipers and Nigerian UN soldiers. Here, of course, there is no bunting, nothing hanging from cars.
Under a rather tattered Serbian flag there is some building work going on. I ask a man shovelling bricks into a wheelbarrow what independence will mean for him. He frantically shovels more bricks and says that he will stay and work, work hard. As for independence, he says, it’s like him coming to my house and saying that it is his. A teenaged boy interjects: “We may celebrate: with guns”.
I ask him what he means. He says that if the Albanians try to bring their celebration across the bridge, to taunt them, they will be ready to defend themselves. But I think the Serbian mood is as much sorrow as anger.
Today is a big day, an emotional day. But how much difference will independence make? Kosovo will declare independence today, but in a sense that is independence from the United Nations, because in reality it has not been ruled from Belgrade for nine years.
While Serbs may regard it as legally part of their country, for nine years there have been borders, and checks on documents between Serbia and Kosovo.
Equally in the north of Mitrovica, and other parts of Kosovo where Serbs live, they use their own currency and under the plan they will have a great deal of autonomy. Of course this does beg the question why they can’t choose to be part of Serbia if ethnic Albanians have the right to live in a new country.
EU flag
I wrote that this was a tale of four flags. The fourth flag is the European Union flag, which again you see hanging from every third building. Indeed I’m told Kosovo’s official flag will probably be pretty much like the EU flag with a map of the country inside the golden stars.
Some might think that rather justly symbolic: Kosovo will have a sort of independence but within parameters set down by the European Union.
Diplomats are very keen to stress that today does not see the United Nations hand over to the European Union. Whereas the UN really was running the show, the EU will just be there to keep an eye on things. But the EU can, in the end, tell the government what to do and what not to do in certain areas.
One senior EU source puts it like this: “We have a big stick. But that big stick is locked in a safe in the cellar. And it would take a lot to make us get the keys out and go downstairs. But we can do it.”
One of the most important people around here is Roy Reeve, a former British diplomat with an easy manner who is at the moment in charge of planning the EU police mission, the biggest task the European Union has ever undertaken.
EU protectorate
I ask him if the arrangement doesn’t make Kosovo an EU protectorate, or even colony.
“It’s been a protectorate up until now but the responsibility is theirs now,” he says. “They are the new government, it’s for them to deliver results. Whatever we’re here to do, it’s not to leap in and take decisions on their behalf, but to work with them to make it clear that they are the ones in charge.”
It is more than simply ironic that, with the EU taking on such a big burden, it cannot get its act together. At tomorrow’s foreign ministers meeting there will be a smooth papering over the cracks, and then about 20 countries will recognise Kosovo.
That would leave seven not really on board for what some might see as the EU’s biggest project to date. But for the time being, that is not what is most important.
The next 24 hours will bring reaction from all around the world. But what happens here, on the ground, is what is vital. Let’s hope the only fireworks are part of the celebratory display.
LEGAL FURORE OVER KOSOSVO RECOGNITION

The recognition of independence for Kosovo raises serious questions of international law as well as sensitive diplomatic difficulties.
The United States and many European Union countries accept that Kosovo should no longer be formally part of Serbia.
They will recognise a limited form of independence for Kosovo, as recommended in a report drawn up for the UN by the former Finnish president Martti Ahtisaari.
The EU is sending a major law and order mission to Kosovo, made up of 1,800 police and justice officials, including judges, in effect taking over from the current UN presence.
Serbia itself, supported strongly by Russia, rejects independence for Kosovo. Serbia and Russia argue that there is no UN Security Council approval for the move and that the parties should continue negotiating until an agreement is reached.
Serbia offered Kosovo autonomy but not independence.
So what are the legal arguments for and against recognition?
The arguments for
After the war over Kosovo in 1999, the UN Security Council took control. In resolution 1244 of 10 June 1999, it ordered the Federal Republic of Yugoslavia (as it then was) to withdraw all its forces from Kosovo and hand Kosovo over to the UN.
The problem is that although the resolution called for a “political solution to the Kosovo crisis”, it did not specify what that solution should be.

EU document
And there has not been any further Security Council resolution mandating independence for Kosovo.
Many Western governments argue that because 1244 does refer to general principles that G8 foreign ministers had agreed in advance of the resolution, these should be used as the basis for the acceptance of independence now.
These principles include the deployment in Kosovo of “international civil and security presences” and “facilitating a political process designed to determine Kosovo’s future status”.
EU legal opinion
The European Union has drawn up, as it is required to do by EU procedures, a document to justify its own mission to Kosovo and the arguments deployed are the same as the ones used to justify recognition.
The document basically argues that independence for Kosovo is within the spirit of 1244, if not strictly within the letter.
The 1244 resolution also envisaged a final status process and did not constrain or pre-determine its outcome.
“Acting to implement the final status outcome in such a situation is more compatible with the intentions of 1244 than continuing to work to block any outcome in a situation where everyone agrees that the status quo is unsustainable,” it says.
The document adds that this approach “will enable, rather than frustrate, the conclusion of the final status process envisaged in resolution 1244″.
And it gives approval to international recognition: “Generally, once a entity has emerged as a state in the sense of international law, a political decision can be taken to recognise it.”

UN plans to tackle limbo
Nato troops under the Kosovo Force (K-For) continue to be mandated by 1244, the opinion holds.
As for the legality of the EU mission, the argument is that there is nothing to stop the EU from taking over from the UN, as 1244 simply refers to “international civil and security presences”. In addition, it suggests that Kosovo could invite the EU to undertake this role.
The document interprets references in the 1244 preamble to Kosovo being part of the Federal Republic of Yugoslavia and to the “territorial integrity” of Yugoslavia as being non-binding.
The arguments against
The counter-argument by Serbia and Russia is simpler. It is that Serbia, the sovereign state, has not agreed to independence for Kosovo, that there is no Security Council resolution authorising the detachment of Kosovo from Serbia and that therefore its independence is illegal.
Some European Union members - Greece, Spain, Cyprus, Slovakia, Bulgaria and Romania - agree, though they have not blocked the EU mission.
Serbia remains strongly opposed to independence
Serbia and Russia also say that 1244 itself gives no authority for independence. They point to article 10 of 1244 which authorises “substantial autonomy with the Federal Republic of Yugoslavia” for Kosovo, meaning, in their view, that 1244 blocks independence.
And they argue that 1244 talks about international organisations being deployed in Kosovo “under United Nations auspices”, which an EU mission would lack.
Russian Foreign Minister Sergei Lavrov had this to say on 12 February: “We are speaking here about the subversion of all the foundations of international law, about the subversion of those principles which, at huge effort, and at the cost of Europe’s pain, sacrifice and bloodletting have been earned and laid down as a basis of its existence.
“We are speaking about a subversion of those principles on which the Organisation for Security and Co-operation in Europe rests, those [principles] laid down in the fundamental documents of the UN.”
The main principle he refers to is that borders should be changed only by agreement.
In Russia and Serbia’s view, since there is no agreement, there should be no recognition.
KOSOVO PREPARES FOR FIRST INDIPENDENCE DAY
PRISTINA, Kosovo (CNN) — Kosovo’s parliament meets Sunday afternoon to officially declare the province’s independence from Serbia, a move opposed by Serbia and Russia but supported by many western governments.
CNN’s Alessio Vinci, reporting from the Kosovar capital Pristina, said that the plan is for Kosovo Prime Minister Hashim Thaci to read out the independence declaration, which is written in Albanian, Serbian and English, to parliament before lawmakers pass it unanimously.
Vinci added that Kosovo’s Albanian population were already singing and dancing in the streets as well as lighting firecrackers ahead of the much anticipated vote. “It’s been like this for several hours now,” he said.
President George Bush said Sunday that Kosovo’s status must be resolved before the Balkans can become stable and that the United States supports the Ahtisaari plan which calls for a form of supervised independence.
The European Union decided Saturday to launch a mission of about 2,000 police and judicial officers to replace the United Nations mission that has been controlling the province since the end of the war with Serbia in 1999.
Kosovo has been under U.N. supervision and patrolled by a NATO-led peacekeeping force since the end of the three-month war, in which NATO warplanes pounded Serbia to roll back a campaign of “ethnic cleansing” of the province’s Albanian population under former then-President Slobodan Milosevic.
The disputed province is dear to the Serbs, Orthodox Christians who regard it as Serbian territory. But it is equally coveted by Kosovo’s ethnic Albanians, Muslims who have a 90 percent majority, and two years of talks on its final status ended in failure last December.
“Its status must be resolved in order for the Balkans to be stable,” President Bush told reporters during a news conference in Tanzania Sunday.
Bush said the Ahtisaari plan — named after former Finnish President Marti Ahtisaari — is the best option. The proposal would give Kosovo limited statehood under international supervision.
President Bush added that “it’s in Serbia’s interest to be aligned with Europe and the Serbian people can know that they have a friend in America.” Watch the changing political climate in the Balkans »
“We are heartened by the fact that the Kosovo government has clearly proclaimed its willingness and its desire to support Serbian rights in Kosovo,” Bush said.
Thaci said Thursday he would establish a new government office for minorities and it would protect the rights of minorities after the province declares independence.
Serbian Foreign Minister Vuk Jeremic has promised his country will refrain from using force against Kosovo after independence, though he has warned that Serbia will take punitive diplomatic, political, and economic measures against the province.
Russia — Serbia’s historic ally — has remain opposed to Kosovo’s independence. Russia, which has fought two wars against separatist rebels in its southwestern republic of Chechnya, has Monday that U.S. and European support for Kosovo’s independence could lead to an “uncontrollable crisis” in the Balkans.
The EU said Saturday that “around 1,900 international police officers, judges, prosecutors and customs officials and approximately 1,100 local staff will be based in headquarters in Pristina or located throughout the judicial and police system in Kosovo.”
The EU mission’s objective is “to support the Kosovo authorities by monitoring, mentoring and advising on all areas related to the rule of law, in particular in the police, judiciary, customs and correctional services,” it said.
In 1999 the international, NATO-led Kosovo Force (KFOR) began providing security for the Serbian province.
“KFOR is fully determined to maintain a safe and secure environment for the times to come. KFOR is almost fully deployed and we will still increase our level of activities for the next couple of days,” said Lt. Gen. Xavier Bout de Marnhac, KFOR commander.
“I just want to state very strongly that KFOR will react and will oppose any kind of provocation that might happen during these days, wherever they come from — either from the Albanian or the Serbian side. The Burrel, nuk eshte thike, por kishte disa dite qe ne korridoret e Parlamentit Europian qarkullonte mendimi/mentaliteti qe vendet e EU te dilnin me nje mendim dhe jo te perçara. Mendim qe u hodh nga disa parlamentare te vendeve te pasura , per/ndaj disa parlamentarve e vendeve te EU, qe kishin shfaqur pakenaqesi per parvarsine dhe mbeshtetje per Serbine. Disa media dhe gazetare , u treguan entuziaste ndaj pavarsise qe do ndodhte (qysh dje dhe pardje) gje qe ndikoi dhe ne rrotullimin e situates nga inatçor me shqiptaret , ne simpatizante te tyre. Nje ndikim paten dhe deklaratat e politikanve serbe per nje aluzion per lufte apo prishje te situates, gje qe i detyroi dhe me skeptiket ta shohin te keqen vertet tek Serbia, shtet i cili vetem turbullira dhe zaptime ka sjell.

Olsib, ajo harta qe solle ketu , me duket se na ngrohu para kohe. Sapo pashe tek lajmet e ores 19 e 20 , ministrin e jashtem belg, Karel de Gusht, qe u shpreh se vendet europiane do mblidhen neser per kete problem, dhe se ne (pra belgjit) do presim sa te njihet nga nje pjese e vendeve. Ai permendi dhe Qipron, si kundershtare e ketij proçesi, dhe u duk sikur shfajesohej apo qe nuk ishte i sigurte ne kete proçes.
Nese ka njeri ndonje lajm te sakte per njohjen nga vendet e ndryshme, eshte mire ta sjelli te sakte.

Feb 17 (Reuters) - Kosovo declared independence from Serbia on Sunday. Serbia responded immediately by calling its mainly Albanian breakaway province a false state.
Following are highlights of the declaration adopted by the Kosovo parliament, in the official English translation:
* Answering the call of the people to build a society that honours human dignity and affirms the pride and purpose of its citizens,
* Committed to confront the painful legacy of the recent past in a spirit of reconciliation and forgiveness,
* Dedicated to protecting, promoting and honouring the diversity of our people,
* Reaffirming our wish to become fully integrated into the Euro-Atlantic family of democracies,
* Observing that Kosovo is a special case arising from Yugoslavia’s non-consensual breakup and is not a precedent for any other situation,
* Recalling the years of strife and violence in Kosovo, that disturbs the conscience of all civilised people,
* Grateful that in 1999 the world intervened, thereby removing Belgrade’s governance over Kosovo and placing Kosovo under United Nations interim administration,
* Determined to see our status resolved in order to give our people clarity about their future, move beyond the conflicts of the past and realise the full democratic potential of our society,
* Honouring all the men and women who made great sacrifices to build a better future for Kosovo,
- We, the democratically elected leaders of our people, hereby declare Kosovo to be an independent and sovereign state. This declaration reflects the will of our people and it is in full accordance with the recommendations of U.N. Special Envoy Martti Ahtisaari and his comprehensive Proposal for the Kosovo Status Settlement.
- We declare Kosovo to be a democratic, secular and multi-ethnic republic, guided by the principles of non-discrimination and equal of all communities in Kosovo and create the conditions necessary for their effective participation in political and decision-making processes.
- We invite and welcome an international civilian presence to supervise our implementation of the Ahtisaari Plan, and a European Union-led rule of law mission. We also invite and welcome the North Atlantic Treaty Organisation to retain the leadership role of the international military presence in Kosovo and to implement responsibilities assigned to it under U.N. Security Council resolution 1244 (1999) and Ahtisaari Plan, until such time as Kosovo institutions are capable of assuming these responsibilities.
- Kosovo declares its commitment to peace and stability in our region of southeast Europe. Our independence brings to an end the process of Yugoslavia’s violent dissolution. While this process has been a painful one, we shall work tirelessly to contribute to a reconciliation that would allow southeast Europe to move beyond the conflicts of our past and forge new links of regional cooperation. We shall therefore work together with neighbours to advance a common European future.
- We express, in particular, our desire to establish good relations with all our neighbours, including the Republic of Serbia with whom we have deep historical, commercial and social ties that we seek to develop further in near future. We shall continue our efforts to contribute to relations of friendship and cooperation with the Republic of Serbia, while promoting reconciliation among our people.

A mund te na qartesoje njeri per qendrimin Grek? Kam pasur pershtypjen se Greqia nuk do ta njihte pavaresine e Kosoves, ndersa fotoja tregon Greqine si pjesemarrese ne shtetet qe njofin pavaresine. Ne artikullin e NyTimes, thuhej se Greqia, Qipro, Sllovakia dhe Rumania, nuk do ta njohin pavaresine e Kosoves.

Sot eshte dite feste, nga Australia ne Kanada, dhe vetem gezohet.
Po neser i duhet pergjigjur ketyre tutkuneve te Newsweek-ut se nuk eshte aspak e vertete se “it’s the first time since World War II that the internal borders of a European country are being redrawn, with the exception of course of Germany. But then, Kosovo is no Germany.”
Kjo dite ishte vdekja perfundimtare e Jugosllavise, jo nje teke Evropiane per te rishikuar kufijte e shteteve sovrane. Ky ishte nje process 20 vjecar, nuk ndodhi as sot as dje.

Hilari Klinton pershendet Kosoven e pavarur
Sipas senatores se Nju Jorkut, deklarata e Prishtines do t’i lejoje Kosoves dhe Serbise “te hedhin pas kraheve nje kapitull te veshtire ye historise se tyre”.
Kandidatja demokrate Hillari Klinton ka pershendentur deklaraten “historike” te pavaresise se Kosoves, ndersa u ka bere thirrje vendeve mike dhe aleate “te bashkohen me SHBA dhe BE per njohjen e Kosoves se pavarur”. La réaction de Moscou n’a pas tardé. Sitôt l’indépendance du Kosovo votée par le Parlement kosovar, dimanche 17 février dans l’après-midi, la Russie a immédiatement soutenu la Serbie en rejetant dimanche la proclamation d’indépendance du Kosovo. Elle a appelé les Nations unies à déclarer “nulle et non avenue” cette déclaration unilatérale d’indépendance.
Avant même cette déclaration d’indépendance, la Serbie avait prévenu qu’elle “ne reconnaîtrait jamais l’indépendance” de sa province sud. “Pour les citoyens de Serbie, pour la Serbie, il n’y a pas et il n’y aura jamais d’Etat fantoche du Kosovo sur son territoire”, a redit le premier ministre serbe, Vojislav Kostunica qui s’en est également pris au président américain George W. Bush pour son soutien à la proclamation de l’indépendance du Kosovo.
Les Etats-Unis, qui ont en effet “pris note” de la déclaration d’indépendance du Kosovo, ont appelé toutes les communautés au calme, selon un communiqué du porte-parole du département d’Etat, Sean McCormack. Le porte-parole a indiqué que les Etats-Unis et l’Union européenne se concertaient pour la suite à donner à cette déclaration d’indépendance, et qu’une reconnaissance, qui devrait être simultanée, interviendrait après un bref délai.
LA FRANCE SOUHAITE “BONNE CHANCE” AU KOSOVO
La Slovénie, qui assume la présidence semestrielle de l’Union européenne (UE), a appelé toutes les parties impliquées au Kosovo à se comporter “de manière responsable” et à “éviter toute forme de violence”. Le diplomate en chef de l’Union européene, Javier Solana, a appelé “tout le monde à agir calmement et de façon responsable”, et s’est dit “convaincu” que les dirigeants kosovars seraient “à la hauteur de leurs responsabilités”.
Plusieurs capitales européennes ont adopté une même attitude prudente. Rome a ainsi “pris acte” de la déclaration d’indépendance du Kosovo, mais “prendra le temps de l’évaluer” avec ses partenaires européens à Bruxelles lundi, selon des sources diplomatiques citées dimanche par l’agence Ansa, qui ont appelé Serbie et Kosovo à la “modération”. Même réaction du côté de l’Allemagne dont le ministre des affaires étrangères, Frank-Walter Steinmeier, a appelé toutes les parties” au “calme et à la modération”. En France, le ministre des affaires étrangères, ancien Haut représentant de l’ONU au Kosovo, Bernard Kouchner, a souhaité “bonne chance au Kosovo”, estimant qu’il s’agissait d’un “succès de la communauté internationale et de l’Europe” qui “mettra fin à une certaine souffrance”.
L’IRLANDE VA RECONNAÎTRE L’INDÉPENDANCE DU KOSOVO
La Suisse attend de son côté de la part des autorités du Kosovo qu’elles s’engagent à “protéger les droits de toutes les minorités”, a déclaré le ministère des affaires étrangères suisse. La reconnaissance du Kosovo par la Suisse ne se fera “qu’après consultations des commissions de politique étrangère”, a ajouté le ministère.
Dès dimanche, l’Irlande a annoncé son intention de reconnaître l’indépendance tandis que la Grande Bretagne a estimé qu’il s’agissait là d’un “important développement”. Lundi les ministres européens des affaires étrangères de l’Union européenne vont discuter du nouveau statut du Kosovo. Chaque Etat membre pourra effectuer une déclaration propre, les 27 pays membres étant divisés sur le sujet. Six pays européens, Chypre, Slovaquie, Espagne, Bulgarie, Grèce, la Roumanie ont déjà exprimé leur opposition à cette indépendance, la considérant comme un précédent pour les séparatismes à travers le monde.
La Slovaquie ne compte pas pour l’instant reconnaître l’indépendance du Kosovo, a annoncé à Bratislava le ministère slovaque des affaires étrangères. L’Albanie a enfin salué la proclamation de l’indépendance du Kosovo et a annoncé considérer le 17 février comme le jour de “sa rennaissance”, a déclaré le premier ministre albanais Sali Berisha.
L’Abkhazie et l’Ossétie du Sud demandent leur indépendace
L’Abkhazie et l’Ossétie du Sud, deux régions séparatistes de Géorgie, ont annoncé, dimanche dès la proclamation d’indépendance du Kosovo, qu’elles allaient demander à la Russie et à l’ONU de reconnaître leur indépendance. – (avec AFP)

Iu kerkoj falje atyre qe s’flasin frengjisht, por meqe kemi ngelur te bllokuar perpara kompjuterit duke pare se çfare po behet per shtetin me te ri ne Bote, nuk kam shume kohe t’i perkthej shkrimet.
Kete rradhe eshte gazeta svizeriane Koha (letemps.ch) qe ka nje shkrim ne lidhje me Kosoven. Zvicra qe aq shume e mbrojti popullin kosovar dhe qe gjithnje thoshte se ishte e vendosur ta njihte pavaresine e Kosoves sapo kjo te shpallej. Nje ngurrim? Apo thjesht nje konstatim i ndonje gazetari?

Me ka cuditur fakti se e vetmja gazete ne bote qe nuk ka botuar as edhe nje artikull per pavaresine e kosoves eshte gazeta zyrtare e Edi Rames : Zeri I Popullit .
Gjithashtu Edi Rama vazhdon dialogun per shendetesine , Gju me gju me popullin .

Cuna ne Kosove, po patet mundesi te shikoni korrispondentin italian te SkyTg24 ne Prishtine, jepini doren prej meje. Eshte fantastik. Me nje dashamiresi te tille me te cilen jep lajmet, vetem televizionet shqiptare mund t’ja kalojne. Gjithe Sky ne pergjithesi eshte shume dashamires.

Ore, a ka ndonje video te Topit apo te Beriches? Se u pa puna, ngelem te ngerthyer nga kjo pavaresi. Sikur te kishte ekzistuar interneti ne kohet e Ismailit e Ises, gje tjeter do t ekishte qene, por te shkretet moren rruget e Shqiperise me karroca dere me dere. Sot, gjithçka eshte falas, e shpejte dhe efikase.
Nga fotot e NYC vura re qe mungonte flamuri kosovar, ndoshta amerikanet kane menduar se eshte shpallur pavaresia e Shqiperise. Megjithate bravo per regullin, duket se ju andej nga USA jeni me patriote dhe keni me shume organizim sesa ne ne Evrope ku jemi pak te ndrojtur nga te tjeret.
Tani fillon puna, kush e njeh dhe kush nuk e njeh dhe se çfare do na rrefeje historia sepse serbomedhenjte nuk jane bere akoma pula e gomere per te leshuar armet, se ato aq dine, te djegin fshatra, te perdhunojne dhe te urrejne. Fatkqesite akoma nuk kane perfunduar per kombin shqiptar. Nje gje e mire ndodhi, nje mrekulli ndodhi, Kosova dhe shqiptaret e Kosoves kane shtetin e tyre qe duhet te dine ta mbrojne dhe ta qeverisin qe te mos lene gojet e keqija te flasin, por t’i tregoje Evropes se civilizuar se edhe ne, shqiptaret brenda dhe jashte Shqiperise, jemi te ndergjegjshem per ftin qe iu dhe nje popullate qe aq shume vuajti e u masakrua nga arma serbe, nga furia e psikopatise millosheviçiane et kargjiçiane. Edhe serbet kane nje moment te mire per te treguar qe jane te moderuar dhe mendojne me te vertete te hyne ne Evrope si shtetas te civilizuar. Por, siç edhe peshkopi Artemije e tha, ata mendojne akoma tek armet, tek bajonetat, tek djegjet, vjedhjet dhe çudnimin e popullit kosovar.
Nga Brukseli duhet te vine lajme besoj, nese ndonjeri eshte ne lidhje, te mos pertoje te na informoje.

Vellezer e motra kudo qe ndodheni,
Ju kerkoj ndjese per mungesen time te djeshme ne komentet e “Peshkut”, por kam qene tere kohen i mberthyer para ekranit te TV, duke kaluar nga nje stacion ne tjetrin per te pare e degjuar komentet per PAVARESINE.
Ju them sinqerisht se ka qene nga ditet e mia me te lumtura e me emocionuese. Emocione te ngjashme kam provuar kur u rrezua Diktatura. Kam qene teper i emocionuar kur me lindi vajza. Por e djeshmja ishte nje ndjenje teper e vecante.
